Terms of Service

1. Acceptance of Terms

By accessing or using Prompteria (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Description of Service

Prompteria is a platform that allows users to create, share, browse, like, and bookmark AI prompts. The Service also includes an AI Chat feature available to subscribers, which provides access to third-party AI language models. Subscription plans include Free, Pro, and Teams tiers, each with different monthly message limits and model access.

3. User Accounts

You must be at least 13 years old to use the Service. To access certain features you must sign in with a Google account. You are responsible for maintaining the security of your account and for all activities that occur under it. You must notify us immediately of any unauthorized use at hello@moltech.dev.

4. User Content

You retain ownership of any prompts or content you submit. By posting content, you grant Prompteria a worldwide, non-exclusive, royalty-free license to display, distribute, and promote that content on the Service. This license ends when you delete the content, except for copies already distributed or retained in standard backup systems, which may persist briefly thereafter. You are solely responsible for content you post and must not submit content that is unlawful, harmful, infringing, or otherwise objectionable.

5. Subscriptions and Payments

Prompteria offers paid subscription plans (Pro and Teams) in addition to a free tier. Payments are processed by Paddle.com Market Limited (“Paddle”), which acts as our Merchant of Record. When you purchase a subscription, your transaction is with Paddle and is subject to Paddle’s Buyer Terms and Paddle’s Privacy Policy. Prompteria does not store your payment card information. Subscription fees are billed monthly in advance. Refunds and billing disputes are handled by Paddle as described in our Refund Policy.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Post content that infringes third-party intellectual property rights.
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure.
  • Use automated tools to scrape, index, or bulk-download content without prior written permission.
  • Abuse the AI Chat feature to generate harmful, deceptive, or illegal content.

7. Third-Party Services and AI Models

The AI Chat feature routes messages to third-party AI providers via OpenRouter. Outputs from these models are not endorsed by Prompteria. You acknowledge that AI-generated content may be inaccurate, and you use such output at your own risk. Payments are processed by Paddle; see Section 5.

8. Intellectual Property

The Prompteria name, logo, and all original platform content are the property of Moltech (Colombia). You may not reproduce or redistribute them without explicit written permission.

9. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive (including intellectual property, disclaimers, and limitations of liability) will survive termination.

10. Disclaimer of Warranties

The Service is provided “as is” without warranty of any kind. Prompteria does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Prompteria and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. We will indicate the date of the most recent revision at the top of this page.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Colombia, without regard to conflict-of-law principles. Any dispute arising from or related to these Terms shall be submitted to the exclusive jurisdiction of the courts of Bogotá, Colombia. If you are a consumer resident in a jurisdiction where mandatory consumer-protection laws apply, those laws are not excluded by this clause.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Prompteria regarding the Service and supersede all prior agreements or understandings.
